Drug Disposal Regulation Comments to Drug Enforcement Agency

The Children's Hospital Association joined the American Hospital Association and other national hospital organizations in signing on to a joint letter to the Drug Enforcement Agency requesting that the agency delay enforcement of provisions in a new rule concerning the disposal of controlled substances. 

The ruling, which is scheduled to take effect this week, has raised concerns because certain provisions are viewed as not readily compatible with established employee and patient safety protocols. In addition, the final rule, which was issued September 9 with only a 30-day compliance period, has new record-keeping requirements that would necessitate employee redeployment and retraining and the addition of new staff. 

The hospital groups are requesting the delay to allow hospitals time to comply and to revisit whether there are alternative ways to meet the DEA’s objectives.
